These Terms of Use ("Terms") are an agreement between you and MarkR Management Inc. ("we", "us", "our"), the provider of the 3A Toolkit course available at 3atoolkit.com/course (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
The service
The Service gives you online access to educational course material created by Dr. Meg Kapil, including a reader, videos, flip cards, and self-reflection prompts. The Service is for personal, non-clinical use. It is educational and is not therapy, counselling, diagnosis, or medical care. Please read our Disclaimer.
Accounts
You sign in with your mobile number and a one-time code sent by text. You are responsible for keeping access to your phone secure and for activity under your account. Accounts are for one person. Do not share your account or the course content with others.
Purchases, billing, and renewal
Access is sold as an annual subscription. Payments are processed by Paddle.com, which acts as the Merchant of Record and seller for your purchase. Paddle handles billing, applicable taxes, and invoices. Prices are shown in Canadian dollars for purchases from Canada and in United States dollars for purchases elsewhere. Subscriptions renew each year unless cancelled. You can cancel at any time as described in our Refund and Cancellation policy.
Family and group access
Some plans give access to more than one person through a shared code. A family plan includes a family code for up to 10 people. A school or organization license includes a school code for the number of seats purchased. Each person signs in with their own mobile number and enters the code once to join. Each seat is tied to one phone, and once the seat limit is reached the code stops accepting new members. Codes are issued for the year and may be rotated. Please share your code only within your household or organization and not beyond your seat limit. Sharing beyond the limit is not permitted, and access may be suspended or a code rotated if misuse is found. School licenses are also covered by our School and Organization License Agreement.
Acceptable use
- Use the Service for your own personal learning.
- Do not copy, download, record, screenshot, republish, resell, or distribute the course content. The reader is watermarked and content is protected.
- Do not share your login or provide access to anyone else.
- Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service.
Intellectual property
All course content, including text, images, video, and design, is owned by Dr. Meg Kapil or her licensors and is protected by copyright. You receive a personal, non-transferable, non-exclusive licence to access the content while your subscription is active. No other rights are granted.
Your own content
Anything you type into the reflection and notes fields is stored on your own device and is not sent to or stored by us. You are responsible for that content and for keeping your own backups if you wish.
Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including fitness for a particular purpose, and we do not warrant that the Service will be uninterrupted, error free, or that any particular result or outcome will be achieved.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Service or the course content. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Assumption of risk
You use the course material at your own discretion and risk. The material is general in nature and may not suit your individual circumstances. You are responsible for deciding whether it is appropriate for you, and for seeking professional advice where needed.
Changes
We may update these Terms from time to time. If we make material changes we will update the effective date and, where appropriate, notify you. Continued use of the Service means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada that apply there, without regard to conflict of law rules.
